These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Party Solutions & Innovations LLC (DBA Montage Photo Booth) ("we," "us" or "our"), concerning your access to and use of the website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
We provide luxury photo booth rental services for events. A booking is only confirmed once a non-refundable retainer has been paid and a contract has been signed by both parties. The remaining balance is due prior to the event date as specified in your individual contract.
Cancellations made by the client will result in the forfeiture of the non-refundable retainer. If cancellation occurs within a certain timeframe prior to the event (as specified in your contract), the client may be responsible for the full remaining balance. We reserve the right to cancel services due to unforeseen circumstances, in which case a full refund will be provided.
The client is responsible for ensuring that the venue can accommodate the photo booth requirements, including adequate space, a solid level floor, and access to a reliable power source within a reasonable distance. The client is also responsible for any damage caused to our equipment by their guests during the event.
Unless otherwise agreed upon in writing, we reserve the right to use images taken at your event for promotional purposes, including on our website, social media, and marketing materials. Guests using the photo booth consent to their images being captured and potentially used in this manner.
Our liability is limited to the total amount paid for our services. We are not liable for any indirect, incidental, or consequential damages arising out of or in connection with our services. We are fully insured, but the client assumes responsibility for the actions of their guests.
These Terms shall be governed by and defined following the laws of the State of Arizona. Party Solutions & Innovations LLC and yourself irrevocably consent that the courts of Arizona shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
